Federal Judge Mandates Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The case stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to face alien smuggling allegations, he was held in immigration detention.
In her order, the judge noted that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The court proceedings involve conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in Tennessee.
Conditions of Freedom
The court, who was hearing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
This ruling represents a significant development in a complex legal battle featuring allegations of mistaken imprisonment and contested gang associations.
